THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.20604 OF 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent No.4 in not granting 'Temporary permit for Earth, to lift and Transport to the petitioner over an extent of Ac.6.07 cents in S.No.676 of land situated in Unguturu (V & M), West Godavari District is bad, illegal and violation of principles of natural justice and Articles 14, 21 and 300-A of the Constitution of India and consequently direct the respondent No.4 to grant "Temporary permit for Earth to lift and Transport to the petitioner without insisting fees of Rs.24,000/- over an extent of Ac.6.07 cents in S.No.676 of land situated in Unguturu (V & M), West Godavari District."

After arguing for sometime, learned counsel for the petitioner requested the Court to direct respondent No.4 herein to consider the representation, dated 22.02.2017, of the petitioner and pass appropriate orders in accordance with law.

Considering the facts and circumstances of the case and the grievance of the petitioner, without going into the merits of the case, respondent No.4 is hereby directed to consider the representation, dated 22.02.2017, of the petitioner and pass appropriate orders in accordance with law as expeditiously as possible.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
