THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4112 OF 2016 ORDER:

This petition is filed by the petitioner-A1 under Section 482 Cr.P.C. seeking to quash the proceedings against him in Special C.C.No.8 of 2015 on the file of the Judicial First Class Magistrate at Alampur, Mahaboobnagar District.

Heard and perused the material available on record. The petitioner and two others are alleged to have committed the offence punishable under Section 304 Part II IPC and Section 135 of the Electricity Act. It is alleged that the second daughter of the de facto complainant viz., K. Lavanya, who is aged about 9 years, went out of the house for attending nature calls, and after 15 minutes, the de facto complainant came to know that his daughter got electric shock and died due to electrocution at the agricultural fields of the petitioner. Considering the facts and circumstances of the case and the offence alleged, this Court is not inclined to grant the relief sought by the petitioner.

At this stage, the learned Counsel for the petitioner sought for dispensing with the presence of the petitioner before the trial Court. In view of the above submission, the presence of the petitioner before the trial Court is dispensed with except on the dates when his presence is specifically required by the trial Court. The petitioner is directed to be represented by a Counsel before the trial Court on all hearing dates.

Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. ______________________
