HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION NO.3637 OF 2017 ORDER:

Heard the learned counsel for the petitioner/ A-1 and the learned Spl.Standing Counsel for ACB Cases.

While granting bail in Crl.M.P.No.171 of 2017, learned I Addl.Spl.Judge for SPE & ACB Cases, City Civil Court, Hyderabad, inter alia, directed the petitioner to appear before the I.O. thrice in a week i.e. on every Monday, Wednesday and Saturday till filing of the charge sheet. Learned counsel would submit that the petitioner/ A-1 is under suspension and he was directed to stay at Headquarters i.e. Nalgonda and in view of the same, the petitioner is finding difficulty to attend before the I.O. at Hyderabad thrice in a week. Learned counsel would further submit that the petitioner earlier filed Crl.M.P.(SR) No.644 of 2017, dated 17.04.2017 before the learned I Addl.Spl.

Judge for SPE & ACB Cases, City Civil Court, Hyderabad seeking for relaxation of conditions, but the said petition was returned and thus, prayed to relax the conditions mentioned supra. Learned Spl.Standing Counsel for ACB Cases would submit that investigation is still in progress and charge sheet is not filed. It is seen that the case under investigation is a trap case. The trap was conducted on 27.01.2017. The petitioner was granted bail on 10.03.2017 and ever-since he has been complying with the bail order condition and there is no adverse report in respect of his compliance.

Considering the fact that the charge sheet is not yet filed, the bail order condition is modified to the effect that the petitioner/ A-1 shall appear before the concerned I.O. once in a week i.e. on Saturday until further orders.

The petition is ordered accordingly.
