HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND HON'BLE Dr. JUSTICE SHAMEEM AKTHER WRIT PETITION No.8289 OF 2017 ORDER: (Per Hon'ble The Acting Chief Justice Ramesh Ranganathan) The action of the 3rd respondent in granting consent for establishment of the 5th respondent unit, vide proceedings dated 28.10.2016, is under challenge in this Writ Petition. Sri T.V. Ramana Rao, learned standing counsel for the 3rd respondent, has placed before us a copy of the proceedings dated 17.03.2017, whereby the 5th respondent's application, seeking consent for operation, was rejected. As the 5th respondent has not been permitted to operate the unit, apprehension of the petitioners', of the unit causing pollution if it were to commence operation, is unfounded.

Suffice it, if the petitioners are granted liberty, in case the 5th respondent were to be given consent for the establishment in future, to question any such proceedings of the Pollution Control Board, in appropriate legal proceedings. Subject to the liberty granted hereinabove, the Writ Petition fails and is, accordingly, dismissed. As a sequel, pending miscellaneous petitions, if any, shall stand dismissed.
