THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.12030 of 2018 ORDER:

In this writ petition, under Article 226 of the Constitution of India, the grievance of the writ petitioner is with regard to release of the petitioner's vehicle said to have been seized in connection with Crime No.11 of 2018, registered on 09.01.2018, on the file of RIMS U/G Police Station, Kadapa.

I have heard the submissions of Sri Manda Venkateswara Rao, learned counsel appearing for the petitioner, and of the learned Government Pleader for Home (A.P.) appearing for the respondents 1 to 4. I have perused the material record. 3.

At the hearing, learned Government Pleader for Home, on written instructions, would submit that the seized property is submitted to the Court of the learned II Additional Judicial Magistrate of First Class, Kadapa, on 23.02.2018, along with Form-60.

In that view of the matter, the Writ Petition is disposed of reserving liberty to the petitioner to approach the Court of the learned II Additional Judicial Magistrate of First Class, Kadapa, and file an appropriate application seeking release of the vehicle for interim custody. It is made clear that in the event the petitioner files any such application, the learned Magistrate shall consider and dispose of the same within a period of two (02) weeks from the date of the said petition, however, by following the procedure established by law. There shall be no order as to costs.

MSRM, J W.P.No.12030 of 2018 Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
