ORDER

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of prearrest bail to the petitioners, who are arrayed as accused Nos. 3 and 4 in Crime No.360 of 2023 before the Armoor Police Station, Nizamabad District, registered for the offences punishable under Sections 307, 506, 195A read with 34 of IPC.

The brief facts of the case are that, the de facto complainant lodged a report before the police on 07.08.2023, stating that due to marital disputes, her husband and his associates have been threatening her for the past two years to withdraw the criminal and divorce cases. She further stated that on 30.04.2023 at about 8:30 A.M., her husband assaulted her with a stick with an intention to kill, causing bleeding injuries to her left hand. She was rescued by nearby villagers and later treated at Government hospital, Nizamabad, as such she expressed apprehension that the accused may again attack her. Hence, requested the police to take necessary action. Based on this report, the police registered a case against the accused for the above-mentioned offences. 3.

Heard Sri N. Srushman Reddy, learned counsel appearing on behalf of the petitioners, and Sri M. Rama Chandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioners submitted that the petitioners are innocent of the said allegations and except stating that they are the sons of A.S.I., there is no such role attributed to the petitioners. The crime is registered in the month of August, 2023 and the alleged offences even according to the de-facto

complainant is in the month of April, 2023, wherein there is a delay of four months delay in lodging the complaint. It is further submitted that there is no sufficient reason mentioned for delay. Considering the delay and also considering that the petitioners have no participated in any offence and also there are no previous crimes committed by the petitioners, he prayed this Court to grant pre‐arrest bail to the petitioners by allowing the present Criminal Petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions, contending that the allegations against the petitioners are serious in nature. It is further contended that though the crime is registered in the year, 2023, the petitioners are absconding from the jurisdiction since 2023. Accordingly, he prayed for dismissal of the Criminal Petition. 6.

In light of the submissions made by both learned counsel and upon perusal of the material available on record, it appears that the petitioners are arrayed as accused Nos.3 and 4 and the allegations against the petitioners are that they along with accused Nos.1 and 2 attacked the de-facto complainant, resulting injuries to the de-facto complainant. The medical certificate shows that simple injuries sustained by the de-facto complainant. Having regard to the facts and circumstances of the case and the nature of

the allegations and also considering the date of offence and date of registration of the crime, this Court deems it fit to grant pre-arrest bail to the petitioners, subject to the following conditions: i.

The petitioners shall surrender before the Station House Officer, Armoor Police Station, Nizamabad District within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/- each with two sureties, for the like sum each.

ii.

The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioners shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m. for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
