THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM SECOND APPEAL No. 207 of 2019 JUDGMENT:

This Second Appeal is filed challenging the judgment and decree dated 15.03.2019 passed by the learned IX Additional Chief Judge, City Civil Court, Hyderabad, in A.S.No.77 of 2017 confirming the judgment and decree dated 06.01.2017 passed by the learned V Senior Civil Judge, City Civil Court, Hyderabad, in O.S.No.1097 of 2013.

Appellant herein, who is the defendant in the aforesaid suit, is the tenant of the suit schedule property. After filing this appeal, he had filed an affidavit before this Court undertaking to vacate the suit schedule property within three (3) months and praying to grant stay of the judgment and decree dated 06.01.2017 in O.S.No.1097 of 2013 for a period of three (3) months. Considering the fact that the appellant is in occupation of the suit schedule property since long time and as he had filed an unequivocal undertaking to vacate the suit schedule property within three (3) months, the said undertaking is accepted and the Second Appeal is disposed of by granting three (3) months time to the appellant to vacate the suit schedule property. The appellant shall vacate the suit schedule property on or before

CKR, J S.A.No.207 of 2019 30.10.2019. It is needless to mention that in the case of the appellant's non-adherence to the aforesaid undertaking, he would be liable to be taken to task under the Contempt of Courts Act, 1971.

Miscellaneous applications, if any pending, shall also stand closed.
