2019-08-19Sanjay Kumar,P.Keshava Rao2 pages

THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE P.KESHAVA RAO WRI T PETI TI ON NO.14246 OF 2019 ORDER: (per SK,J) The grievance of the petitioner is that the respondents and more particularly, Kaloji Narayana Rao University of Health Sciences, Warangal, is not treating her as a local candidate by considering the nativity of her parents at Jangaon and Warangal in the State of Telangana for the purpose of admission to Medical Courses during the academic year 201920. 2.

Perusal of the record would reflect that the petitioner secured NEET All India Rank 3,73,463 and she belongs to BC-D Reservation Category. While so, the Registrar of the respondent University filed an additional counter affidavit stating that in the I Phase Counselling for admission to MBBS Course, the last admitted candidates in BC-D category were holding NEET All India Rank 42,074 (under BC-D General) and NEET All India Rank 41,202 (under BC-D Female category). After the II Phase Counselling, the last candidate who secured a seat under BC-D category in BC-D General held NEET All India Rank 61,005 and the last female candidate who secured a seat under BC-D Female Category was holding NEET All India Rank 61,008.

3.

In the light of the aforestated unrebutted facts, we are of the opinion that there is no point in the petitioner seeking adjudication of her local/non-local status as she would not come within the zone of consideration, in any event.

4.

The writ petition is accordingly dismissed on this short ground leaving the said issue open.

5.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
