THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.8731 OF 2016 ORDER:

The prayer of the petitioner, a student, is as under: "For the reasons stated in the accompanying affidavit, it is therefore prayed that the Hon'ble Court, in the interest of justice, be pleased to issue an order or direction more particularly one in the nature of Writ of Mandamus to declare the action of the 2nd and 3rd respondents for not issuing the Hall Ticket for Sixth (Final) Semester Examination on the ground of short fall of attendance is illegal, arbitrary and unconstitutional and consequently direct the respondents to allow the petitioner to appear for Sixth (Final) Semester Examinations by issuing hall ticket and pass such other and further order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

The petitioner is undergoing Electrical and Electronic Engineering Course in the third respondent polytechnic college. Admittedly, he has only 49.3% attendance in the sixth semester. Though various excuses have been put forth by the petitioner to explain his failure to attend the classes, the fact remains that the petitioner did not even attend 50% classes. In a professional course of this nature, attendance is vital. No details have been furnished by the petitioner as to what is the requisite percentage and as to up to what percentage of attendance the shortfall can be condoned. In any event, given the facts as afore-stated, this Court finds no reason to grant relief to the petitioner.

The writ petition is devoid of merit and is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
