THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.20206 of 2015 ORDER:
The petitioner is doing rice business. On 22.06.2015, the 3rd respondent along with Revenue Inspector, Rajendranagar and Village Revenue Officer, Mekkapur Village visited the godown of the petitioner and conducted panchanama, wherein he found that the petitioner possessed 570 bags of rice in FCI bags and 92 bags of rice white plastic bags totalling 341.50 quintals, valued at Rs.3,97,800/-, and that proceedings under Section 6-A of the Essential Commodities Act, 1955, (for short 'the Act') were initiated against the petitioner. Now, the petitioner seeks release of the said rice on his furnishing security for the total amount of Rs.3,97,800/-, pending proceedings under Section 6-A of the Act.
In the facts and circumstances of the case, the Writ petition is disposed of directing the 2nd respondent to release the seized stock of 341.50 quintals of rice valued at Rs.3,97,800/- on the petitioner furnishing bank guarantee for the said amount within a period of two weeks from the date of receipt of a copy of this order. No costs.
Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
