THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36147 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed by the petitioner to declare the action of the 1st respondent in not considering the petition filed under Section 151 Cr.P.C., and granting interim suspension order, besides the revision petition, dated 14.10.2016, filed under Section 6 of the A.P. Schedule Area Regulation 1959, challenging the order, dated 27.08.2016, made by the 2nd respondent in C.MA. No.76 of 2014 therein setting aside the orders, dated 07.06.2012, in Case No.36/ 2012/ PNK on the file of the 3rd respondent, as illegal and arbitrary and consequently, direct the respondents 1 to 6 not to dispossess the petitioner from the land of an extent of Ac.1-21 guntas, in Sy.No.
915 situated at Edurla Bayyaram Village, Pinapaka Mandal, Bhadaradir Kothagudem, District, pending disposal of the revision petition, dated 14.10.2016. Heard and perused the material available on record. When the matter is taken up for hearing, it is informed by the learned counsel appearing for the parties, that already revision petition is filed by the petitioner before the authority concerned on 14.10.2016, and the same is pending consideration, before the authority concerned. The main grievance of the petitioner is that no interim orders are passed in the revision petition, dated 14.10.
2016, and in case the interim orders are not passed by the competent authority, it may cause prejudice to his case, and therefore, he prayed to grant interim order, prohibiting any further action on the basis of the earlier orders passed by the respondents, till the disposal of the revision petition.
Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, 1st respondent is directed to dispose of the revision petition filed by the petitioner, dated 14.10.2016, as expeditiously as possible, preferably, within a period of six (6) months from the date of receipt of a copy of this order. Till the disposal of the revision petition, the respondents are directed not to proceed further in the matter. Accordingly, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
