2. Petitioner is an L.P.G.Dealer carrying on business in the name of Sarathi Gas Agencies. On the basis of vigilance check on 16.12.2014, several empty and full gas cylinders and regulators were seized under Section 6A proceedings. Petitioner states that he has already approached the District collector, respondent No.2, seeking release of the said seized stock by filing an appropriate application as early as on 19.12.2014. Petitioner also states that he is willing to furnish appropriate bank guarantee to the satisfaction of respondent No.2 as a condition for seeking release. However, alleging that no orders are being passed and continuation of seizure of stock is causing serious hardship to the petitioner, the present writ
petition is filed.
3. In my view, keeping the stocks seized under Section 6A proceedings serves hardly any purpose. Hence, pending detailed enquiry, the stocks can be released subject to imposition of appropriate condition, particularly, as the petitioner is willing to furnish appropriate bank guarantee.
4. Hence, the writ petition is disposed of directing respondent No.2 to pass appropriate orders on the petitioner's application for release of seized stock dated 19.12.2014 preferably within two weeks from the date of receipt of a copy of this order.
As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
