HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.35844 OF 2016 ORDER:

This Writ Petition under Article 226 of the Constitution of India is preferred by the petitioner seeking to declare the inaction of the 1st respondent in disposing the revision petition dated 17.08.2016 including stay petition filed by the petitioner as arbitrary and illegal.

Heard the learned counsel for the petitioner and the learned Asst. Government Pleader for Revenue (TG) for respondents 1 to 5. With their consent, the Writ Petition is disposed of at the stage of admission itself.

A perusal of the material on record would show that the petitioner filed a revision dated 17.08.2016 before the 1st respondent. Along with said revision, petitioner also filed an IA seeking stay of order dated 18.07.2016 passed by the Joint Collector in Appeal No.61 of 2015. It is the grievance of the petitioner that till date neither the revision nor the stay application are disposed of. Hence, this writ petition.

Learned AGP submits that since the revision was filed in the month of August, 2016, necessary direction may be given to R.1 to dispose of the stay petition, if not already disposed of. Having regard to the rival submissions made, the Writ Petition is disposed of directing the 1st respondent-The Principal Secretary, Department of Revenue, Secretariat, Hyderabad, to

dispose of the stay application filed by the petitioner, after hearing the petitioner and any other aggrieved persons, if any, in accordance with law as early as possible, preferably within a period of three weeks from the date of receipt of a copy of this order. Further, in view of the representation of the learned counsel for the petitioner that the petitioner is in possession, status quo as on today shall be maintained with regard to subject property for a period of three weeks.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed. There shall be no order as to costs. ________________________ C. PRAVEEN KUMAR, J Date: 24.10.2016 sur
