In this Company Petition, the National Company Law Tribunal, Hyderabad Bench, already passed Orders dt.23.02.2018 winding up the respondent company, in CP (IB) 10/ 7/ HDB/ 2017.

While disposing of the Company Petition, the National Company Law Tribunal, had directed the respondent company to be liquidated in the manner as laid down in Chapter-3 of the Insolvency and Bankruptcy Code, 2016, and issue a public announcement stating that the Corporate Debtor is in liquidation. In terms of the said Order, the Liquidator shall make public announcement in Form-B of Schedule-2 clearly calling the stakeholders to submit their claims as on the announcement of the liquidation date and also stipulating the last date for submission of such claim. On the publication of such notice, the respondent authorities have a right to make their claims before liquidator which are required to be considered in terms of the Insolvency and Bankruptcy Board of India (Liquidation Process) Regulation, 2016.

In the facts of the present case and on account of the fact that the respondent company is under liquidation, this Company Petition is closed, giving liberty to the petitioner to make its claim before the liquidator in terms of the 2016 Regulations.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
