THE HON'BLE SRI JUSTICE A. ABHISHEK REDDY WRIT PETITION No.16386 of 2021 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Irrigation and Command Area Development appearing for respondent Nos.1 to 4. With their consent, the present Writ Petition is being disposed of at the admission stage.

Aggrieved by the action of the respondents in constructing a check dam upstream if the lift irrigation scheme meant for the farmers of the petitioner society, the petitioner society has filed the present Writ Petition.

Having regard to the fact that the petitioner society already made a representation dated 17.06.2021 to respondent No.4 - Executive Engineer, Irrigation Division 3, Huzoornagar, Suryapet District, expressing the difficulties and consequences of constructing the check dam and with a request to provide a provision by putting a 2 feet pipe with a shutter to the check dam, without going into the merits or demerits of the case, this Writ Petition is disposed of with the direction to respondent No.4 to consider the representation dated 17.06.2021 said to have been made by the petitioner society and pass necessary orders in

AAR, J W.P.No.16386 of 2021 accordance with law, as expeditiously as possible, preferably, within a period of four (4) weeks from the date of receipt of a copy of this order, duly putting the petitioner society on notice and considering their objections, if any. A copy of such order that may be passed by respondent No.4 shall be communicated to the petitioner society.

Miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
