HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CONTEMPT CASE No.926 of 2019 ORDER:

This Contempt Case is filed alleging willful disobedience of the order dated 02.7.2018 passed by this Court in I.A.No.1 of 2018 in Writ Petition No.12308 of 2018.

Learned counsel for the respondent-bank contended that the petitioner has earlier filed C.C.No.72 of 2019 alleging violation of the very same order for which the present Contempt Case is filed. A copy of order dated 07.6.2019 passed in C.C.No.72 of 2019 is placed before this Court.

In the order dated 07.6.2019 passed in CC.No.72 of 2019, this Court recorded that the learned counsel appearing for the petitioner himself submitted that the aforesaid order has been complied with and accordingly, the said Contempt Case was closed. In the affidavit, filed in support of the present Contempt Case, there is no whisper of the order dated 07.6.2019 passed in C.C.No.72 of 2019. Without disclosing the fact of filing of CC.No.72 of 2019 earlier and its disposal, the petitioner again filed the present Contempt Case alleging disobedience of the very same order which was subject matter of C.c.No.72 of 2019.

In the light of the above, this Court finds no merit in this Contempt Case and the same is accordingly dismissed. No order as to costs.
