This writ petition is filed challenging the proceedings dated 12.05.2016 passed by the 4th respondent-Tahsildar, Gopavaram, YSR District under Section 6 of the A.P.Land Encroachment Act, 1905 (for short 'the Act').

Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue.

Learned counsel for the petitioner submits that the 4th respondent ordered to vacate the encroachment voluntarily within 21 days from the date of receipt of the notice otherwise threatened to evict the petitioners without following due process of law. Since the time prescribed for filing of the appeal is 60 days, the petitioners may prefer appeal before the appellate authority within such time. In view of the same, petitioners are permitted to file appeals against the impugned order dated 12.05.2016 within a period of three weeks from today. On such filing, the appellate authority shall decide the same in accordance with law. Till such time, there shall be stay of demolition and eviction of the petitioners from the subject land in the writ petition. Accordingly, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending, shall stand closed. _______________________ A.RAJASHEKER REDDY, J 01.06.2016.
