When there was no representation for the appellant, on 01-08-2017, the Registry was directed to list the present appeal under the caption 'for dismissal'.

Today also there is no representation for the sole appellant, who is 2nd respondent in O.P.No.257 of 2001. In fact, against the 3rd respondent herein, the present C.M.A. was already dismissed for default, on 08-02-2016 and it appears that no steps were taken to get it set aside. 3.

Accordingly, the Civil Miscellaneous Appeal is dismissed for non-prosecution. No costs.
