ORDER
This writ petition is filed challenging the action of respondents 3 and 4 in proposing to attach Flat No.201, Vijay Sadan Apartment bearing No.334/2RT, Municipal No.7-1-621/404, situated at Sanjeevareddy Nagar, Hyderabad, pursuant to the show cause notice dated 31.3.2015 issued by the 2nd respondent in connection with Cr.No.32 of 2015 registered by the 3rd respondent.
Learned Government Pleader for Home, based on written instructions received from the 4th respondent-Revenue Divisional Officer, Secunderabad, submits that by oversight wrong file number was shown in the show cause notice, but the present case relates to file No.A/116/2015. He further submits that the 3rd respondent reported to the 4th respondent that a case was registered under Sections 3 and 4 of the Immoral Traffic Prevention Act, 1956, as brothel house is being run in the said house. He requested the concerned authorities to seize the said premises. The case was taken up by the 4th respondent and show cause notice was issued on 31.3.2015 to one P.Nihar Varma. In reply thereto, the said Varma filed a petition stating
that he has been to USA for pursuing Masters Degree and requested for issuance of a fresh date for his appearance. The petitioner did not file any application claiming ownership or explanation to the show cause notice. Ultimately, it is stated that if the petitioner approaches the 4th respondent with relevant records and explanation, appropriate orders would be passed after verification of the same by the Tahsildar and concerned police station.
In view of the same, liberty is given to the petitioner to approach the 4th respondent and submit necessary explanation with relevant records within a period of one week from the date of receipt of a copy of this order and on receipt of the same, the 4th respondent shall pass appropriate orders in accordance with law, within four weeks thereafter.
Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed. ___________________________________ JUSTICE A.RAMALINGESWARA RAO 13th April, 2017 rkk
