The petitioner herein is the 2nd judgment debtor in E.P.No.131 of 2014 on the file of Principal Senior Civil Judge, Ranga Reddy at L.B. Nagar. The 1st respondent obtained an award dated 15-03-2014 in AACF.No.68 of 2012 passed by the Deputy Registrar of Chits/Arbitrator, Ranga Reddy (East) L.B. Nagar and filed E.P.No.131 of 2014. In the said E.P., an order was passed on 05-08-2015 directing the Salary Disbursing Officer/Senior Divisional Manager, LIC of India, Hyderabad, attaching an amount of Rs.2,65,117/- due under the decree and asking the said Salary Disbursing Officer to withhold the said sum of Rs.88,372/- from the salary of the petitioner herein in monthly instalments by one third of salary after excluding first one thousand rupees under Section 60 of CPC and to remit the said sum to the Court. Challenging the said order, the present Civil Revision Petition is
filed.
The learned counsel for the petitioner submits that the award was passed without issuing any notice to the petitioner and the petitioner is not a guarantor, who has signed the chit agreement. The award was passed on 15-03-2014 by the Deputy Registrar/ Arbitrator, Ranga Reddy District (East) L.B. Nagar, Hyderabad and no appeal was filed challenging the said award. The said award has become final.
In view of the same, this Court cannot entertain the plea touching the merits of the award. However, if the petitioner has any grievance with regard to attachment of the salary, it is open to the petitioner to approach the learned Principal Senior Civil Judge, Ranga Reddy District in the pending E.P.No.131 of 2014 and seek appropriate orders.
The Civil Revision Petition is accordingly dismissed. No costs. As a sequel thereto, miscellaneous petitions if any pending shall stand closed.
