THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION NO.8705 of 2016 ORDER:

This Writ Petition is filed questioning the action of the 5th respondent-Kalarayannagudem Gramapanchayat in resorting to dig bore well on the road situated in between the petitioner's house bearing No.3-2 and Ramalayam Temple at Kalarayannagudem Village, Lingapalem Mandal, West Godavari District. The allegation of the petitioner is that respondent No.5Kalarayannagudem Gramapanchayat is digging a bore well in front of the petitioner's house, which in fact is a road. It is the contention of the petitioner that the water in that particular area is saline and there is also another drinking water facility at a distance of 400 meters with 15 HP and 20 HP submersible motors.

It is also the allegation of the petitioner that at the instigation of Sarpanch and Upa Sarpanch of the village, the 5th respondent making preparation for digging bore well in front of his house. Complaining these aspects, petitioner made a detailed representation to the 3rd respondent-District Panchayat Officer, on 08.03.2016. In spite of that the 3rd respondent-District Panchayat Officer has not enquired into the complaint and sorted out the grievance of the petitioner. Hence, the writ petition. Learned counsel appearing for the 5th respondent would submit that it is only an apprehension on the part of the petitioner and no other person, other than the petitioner, seems to have a grievance about the digging of the bore well. He seeks time for filing counter.

Considering the limited grievance of the petitioner, interest of justice would be served if a direction is given to the 3rd respondent to take into consideration of the representation made by the petitioner and deal with the same.

representation made by the petitioner shall be done within 15 days from the date of receipt of this order. Till such time a decision is taken, the proposed digging of the bore well in front of the petitioner's house shall be kept on hold.

With the above direction, the Writ Petition is disposed of. As a sequel, pending miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
