THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8579 of 2015 ORDER:
This Criminal Petition is filed by the petitioners-Accused Nos.1 & 2 under Section 437 and 439 Cr.P.C. seeking to grant bail to them in Crime No.61 of 2015 of Vallur Police Station, YSR District, registered for the offence punishable under Sections 307, 324, 506 r/w 34 IPC.
Heard and perused the material available on record. The de facto complainant-Mummadi Narasimha Reddy has Ac.20.00 cents of agricultural land and he has two sons and two daughters. He gave Ac.8.00 cents of land to each son and retained Ac.4.50 cents for his personal use. Out of Ac.4.50 cents he sold away Ac.2.75 cents and distributed the sale proceedings among them and he retained Ac.1.75 cents and he informed to his sons that after his death, the said property will be distributed among his two sons. It is alleged that from 10 days prior to the incident, the elder son insisted the de facto complainant to keep the property in his name. While so, on 27.7.2015, A1 and A2 alleged to have come to the house of the de facto complainant and threatened him to execute a document in their favour regarding the said property.
A1 hacked the de facto complainant with machukathi on his head and A2 beat him with an iron rod on his cheek and on that, the wife of the de facto complainant and his younger son came there and on seeing them, the accused left the scene and thereafter, basing on the statement of the de facto complainant, a case was registered.
It is stated that the injured is in hospital and his condition is critical. Considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioners at this stage.
