ORDER
This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of prearrest bail to the petitioner, who is arrayed as accused No.1 in Crime No.71 of 2026 of Thalakondapally Police Station, Future City District, registered for the offences punishable under Sections 318(4), 316(2), 316(5) of the BNS and Section 66-D of the ITA Act, 2008.

The case of the prosecution is that, on 10.04.2026, the defacto complainant, who is a Tahsildar, lodged a report before the police stating that during verification of online registration transactions of patta lands in Khanapur village and Venkatraopet villages of Talakondapally Mandal, serious financial irregularities were detected. As informed by the District Collector's Office, Ranga reddy, Government funds were misappropriated during the online slot booking process. Later, they came to known that the irregularities appear to have been committed by the petitioner herein, who is running Mee Seva Centre, Urkonda and the petitioner herein misappropriated funds by exploiting technical glitches in the Bhu-Bharati Software and electronic devices.
He allegedly collected Stamp Duty, Transfer Duty, Registration Fee, and User Charges, but failed to remit the full amount to the Government. The act constitutes criminal breach of trust, cheating, and misappropriation of public funds. Hence, the complainant requested for necessary action. Basing on the said complainant, the police registered a case for the above said offences.

Heard Sri Katika Ravinder Reddy, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor for respondent -State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the said allegations and he was implicated in other cases with the similar allegations and he was also remanded to the judicial custody and a case was registered against him in Crime No.10 of 2026 of Jangaon Police Station with the similar allegations and the petitioner herein was already granted anticipatory bail in Crime No.23 of 2026 of Urkonda Police Station. It is further submitted that the petitioner herein is ready to cooperate with the investigating authority. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by learned counsel for petitioner stating that the allegations against the petitioner are serious in nature and he misappropriated public fund and he also used the technical glitches in the Bhu-Bharati Software and electronic devices and the investigating authority has to investigate about the same. As such, the custodial interrogation of the petitioner is required for further investigation. Therefore, he prayed the Court to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and on a perusal of the material available on record, it
appears that the petitioner was already arrested in other crime with the similar allegations and the petitioner was already granted anticipatory bail in Crime No.23 of 2026 of Urkonda Police Station and the petitioner was in jail at the time of registration of the present crime also. Considering the facts and circumstances of the case, the allegations against the petitioner herein, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to the following conditions:
i.
The petitioner shall surrender before the Station House Officer, Thalakondapally Police Station, Future City District, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/-, with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of 8 weeks or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
