HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.6244 of 2015 ORDER:

Heard.

The petitioners allege that the 4th respondent executed agreement of sale in their favour with respect of property house bearing Nos.14-11-18, 19 and 727 admeasuring 252 sq. yards situated at Jinsi Chowraha, Lower Dhoolpet, Hyderabad. The petitioners also allege that they have paid entire consideration to the 4th respondent and filed the present writ petition on the allegation that the 4th respondent has pressurized the 3rd respondent and thereby, the 3rd respondent is calling the petitioners to the police station and threatening them to settle the matter with the 4th respondent. The petitioners also state that when they were called by the police on 0603-2015, they have made a representation before the 2nd respondent on 09-03-2015. Alleging inaction, the present writ petition is filed.

Learned Government Pleader has received instructions from the 3rd respondent, which state that the 4th respondent approached the 3rd respondent and made a complaint against the petitioners. Based on that, the 3rd respondent made preliminary enquiry and on finding that the dispute between the petitioners and the 4th respondent is of civil in nature, advised the 4th respondent to settle the matter through a competent court. The petitioners' allegation that they were called to the police station and threatened them is denied.

Evidently, the 3rd respondent has not taken any action on the complaint of the 4th respondent on finding that the dispute between him and the petitioner is of civil in nature and that the petitioner and the 4th respondent are required to settle the said dispute by taking appropriate recourse though competent civil court.

petitioners, is denied, the writ petition is disposed of giving liberty to the petitioners and the 4th respondent, as stated above. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
