THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 16807 of 2020 ORDER:

This Writ Petition is filed seeking a mandamus to declare the action of the 3rd respondent in displaying the petitioner's CIBIL score in their website which is accessible to their business partner banks and financial institutions without any notice to him (the petitioner), as illegal and arbitrary and consequently, direct the 4th respondent bank to sanction loan to the petitioner without taking into consideration the CIBIL score displayed by the 3rd respondent. A perusal of the documents on record discloses that the petitioner wrote a letter to the 3rd respondent wherein he failed to mention his details except stating that he had approached the 4th respondent bank which refused to grant loan on the ground that his CIBIL score is bad.

Heard learned counsel for the petitioner.

Learned Standing Counsel for the 4th respondent, on instructions, submits that the petitioner neither approached the bank nor made any Application to the bank to inform the CIBIL score. He further submits that subject to satisfying the criteria laid down by the Reserve Bank for lending money and also the bank norms, all the customers are welcome to avail the services of the 4th respondent bank including loan facility.

In view of the said submission, the Writ Petition is disposed of with liberty to the petitioner to approach the bank of his choice and obtain loan subject to his satisfying the norms laid down therefor. No costs.
