HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.14444 OF 2003 ORDER:

This writ petition is filed seeking to issue a Writ of Mandamus declaring the proceedings issued by the 2nd respondent dated 29.12.2002 deploying the petitioner to operation depot, as illegal and arbitrary, and consequently, to set aside the said proceedings, and to declare that the petitioner is not excess staff.

When this matter is taken up for hearing, the learned Counsel for the petitioner submitted that in pursuance of the interlocutory order dated 18.7.2003, the petitioner is being continued in service.

Admittedly, the impugned proceedings were issued without any notice to the petitioner. If at all the respondents intend to re-categorize the services of the petitioner, they are at liberty to do so after putting the petitioner on notice, in accordance with law.

Accordingly, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions, pending, if any, shall stand closed.
