THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.5150 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner - accused No.1 in Crime No.56 of 2023 pending on the file of Station House Officer, Husnabad Police Station, Siddipet District, filed for the offences punishable under Sections 406 and 420 of Indian Penal Code (for short 'IPC'). 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State. Perused the record.

The petitioner, along with others, is accused of misappropriating a stock of over 95,234.94 Quintals of Paddy which had to be given to the Civil Supplies Corporation after milling the Paddy provided by the Corporation. On perusal, it was found that there was shortage of 95,234.94 Quintals of Paddy which is valued at around 22 crores.

Learned senior counsel appearing for the petitioner has not disputed the said shortfall of paddy. However, he submits that the entire shortfall would be given to the Corporation within a period of six (6) months by the petitioner and to prove his bonafides, the petitioner would start sending rice to the Corporation immediately after release from jail.

In view of the said undertaking given by the learned senior counsel appearing for the petitioner, the petitioner can be granted the relief of regular bail for a period of five (5) weeks from today i.e., 21.06.2023 to 28.07.2023, subject to conditions. 6.

Accordingly, the Criminal Petition is allowed and the petitioner-accused No.1 is granted interim bail subject to the following conditions:

i) The petitioner - accused No.1 shall execute a personal bond for a sum of Rs.2,00,000/- (Rupees Two Lakhs only) with two sureties for a like sum each to the satisfaction of the Principal Judicial Magistrate of I Class, Husnabad.

ii) The petitioner - accused No.1 shall appear before the concerned Station House Officer on every alternate day between 10.30 AM and 01.00 PM, after his release until 27.07.2023. iii) The petitioner - accused No.1 shall surrender before the Principal Judicial Magistrate of I Class, Husnabad, on 29.07.2023. However, the petitioner is at liberty to seek further bail order after completion of his bail period i.e., 21.06.2023 to 28.07.2023 and on the basis of subsequent developments considering the undertaking by the petitioner.

iv) The petitioner - accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
