THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITON No. 36604 OF 2016 ORDER:

This writ petition is filed seeking to declare the action of the respondents in not granting construction permission and approval for the construction of a Residential Building with stilt + two floors in respect of Plot No.993 in Survey No.44/1 of Mathrusri Cooperative House Building Society Limited, Miyapur Village, Serilingampally Mandal, Ranga Reddy District, as illegal and arbitrary and consequently direct the respondents to grant Building Permission duly considering the application in File No.3/C12/00272/2016, dated 08.07.2016. 2.

Learned counsel for the petitioner as well as learned Standing Counsel for the respondents submits that in similar circumstances this court disposed of writ petition viz., W.P.No.26895 of 2016 by order dated 11.08.2016 and hence, the same order may be passed in the present writ petition as well.

Following the order passed in W.P.No.26895 of 2016, this Writ Petition is also disposed of directing respondent Nos.2 and 3 to consider the application of the petitioner for grant of building permission in the subject land within a period of eight weeks from the date of receipt of a copy of this order subject to the petitioner satisfying requirement of Section 428 of Greater Hyderabad Municipal Corporation Act, 1955 and also subject to the petitioner giving an

undertaking that the petitioner would not claim any equities or costs of the building construction, in the event LGC been decided against the petitioner, without reference to the letter dated 31.10.2013 of the Zonal Commissioner, GHMC, Hyderabad.

Office to append a copy of the order in W.P.No.26895 of 2016 to this order.

As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
