THE HON'BLE SRI JUSTICE M.LAXMAN CRIMINAL PETITION No.5134 of 2023 ORDER:

This petition is filed seeking anticipatory bail under Section 438 of Criminal Procedure Code, 1973 (Cr.P.C). The petitioners are accused Nos.1 and 2 in Crime No.264 of 2023 of Osmania University Police Station, Hyderabad District. The offences alleged against the petitioners are Section 306 read with 511 of Indian Penal Code.

The sum and substance of case of the prosecution is that the petitioners and the deceased were the business partners and there are business disputes among them. The allegation is that there are messages by voice recording, threatening and abusing in filthy language. As a result, the deceased committed suicide. 3.

Learned counsel for the petitioners stated that the petitioners have not committed any offence as alleged by the prosecution and a false case has been foisted against them. 4.

Learned Additional Public Prosecutor appearing for the State opposed to grant anticipatory bail to the petitioners.

Heard learned counsel on either side and perused the material placed on record.

A perusal of the record shows that absolutely there is no reference of nature of threat and abuse made by the present petitioners. The date on which such threatening and abuse were made, is not given so as to have no impact on the mental ability of the deceased to commit suicide. From the above facts, this Court feels that it is a fit case to grant anticipatory bail by imposing some conditions.

Accordingly, the Criminal Petition is allowed on the following terms and conditions:

(i) The petitioners/accused Nos.1 and 2 is enlarged on bail in the event of their arrest in connection with FIR No.264 of 2023 on the file of the Station House Officer, Osmania University Police Station, Hyderabad District, on their executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties to the like sum each to the satisfaction of concerned Station House Officer.

(ii) The petitioners/accused Nos.1 and 2 shall appear before the Station House Officer, the Station House Officer, Osmania University Police Station, Hyderabad District, on

every Sunday between 10.00 am and 05.00 pm, for a period of three months.

(iii) The petitioners/accused Nos.1 and 2 shall abide by the other conditions stipulated in Section 438 (2) Cr.P.C and co-operate with the Investigating Officer in investigating the case.
