This writ petition is filed aggrieved by action of the 3rd respondent in threatening the petitioner to produce his lorry bearing No.AP-29-T-2962 before him in relation to Cr.No.136 of 2019. Learned Public Prosecutor appearing for respondent-police submits that since subject vehicle is involved in the crime, the same was seized, as such the same was kept with the complainant and as per Section 102(3) Cr.P.C., the same was informed to the concerned jurisdictional Magistrate after conducting necessary seizure panchanama and that the petitioner can approach the concerned Court under Section 457 Cr.P.C.
Heard learned counsel for the petitioner, who, submits that the issue is only regarding steel loaded in the lorry. However, after unloading the steel, the subject lorry cannot be returned to the complainant.
It is stated that subject vehicle itself is involved in the crime, the petitioner has alternative remedy before the concerned Court. In view of the same, the writ petition is disposed of granting liberty to the petitioner to approach the concerned Court by filing an application and on such application, the concerned Court is directed to consider the same and pass orders in accordance with law. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
