THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CIVIL REVISION PETITION No.2306 of 2018 ORDER:

The present Civil Revision Petition is filed by the respondenthusband in I.A.No.759 of 2016 in FCOP.No.249 of 2016 on the file of the Judge, Family Court, Secunderabad, questioning the order, dated 07.03.2018, passed in the said I.A.

In fact, the aforesaid FCOP was filed by the husband for grant of decree of divorce by dissolving the marriage between him and his wife. The aforesaid I.A., under Section 24 of the Hindu Marriage Act, was filed by the wife seeking interim maintenance for her minor children. Heard Sri D. Madhava Rao, learned counsel for the revision petitioner-husband.

The present revision petition is taken up for disposal at the admission stage, as there is no necessity to issue notice to the respondent.

The Court below, while deliberating on the documentary evidence Exs.P1 to P22 and Ex.R1 and considering the fact that the wife was running a Nursing Home, directed that both, wife and husband, should bear the expenses in equal halves so far as the educational expenses of minor children, whose names are given in the petition, are concerned, however, subject to the production of fee receipts by the wife. Further, the husband was directed to pay Rs.10,000/- each towards monthly

maintenance, as both children are daughters. This part of the order is now questioned by the revision petitioner in the present petition. As could be seen from the material on record, both the children are studying in St. Anns High School at Tarnaka and, certainly, besides meeting educational expenses, to meet other necessities of the children, Rs.10,000/- to each child towards interim maintenance, cannot be viewed as excessive. In fact, excess expenditure and other incidental expenditure ought to be borne by the wife. There is no material irregularity to interfere with the order under challenge. Hence, the Civil Revision Petition is dismissed at the admission stage.

Miscellaneous Petitions, if any, pending in the present petition, stand closed.
