THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.12159 of 2018 ORDER:

In this Writ Petition, under Article 226 of the Constitution of India, the only grievance of the writ petitioner is about noncompletion of the investigation into the case in Crime No.286 of 2015, on the file of Town Police Station, Jangaon, Jangaon District, though the crime was registered in the year 2015. 2.

I have heard the submissions of Sri V.V.L.N.Sarma, learned counsel appearing for the petitioner, and of the learned Government Pleader for Home (Telangana) appearing for the respondents 1 to 3. I have perused the material record. 3.

At the hearing, learned counsel for the petitioner brings to the notice of the Court the pendency of a civil suit, wherein it was alleged that the signature on the agreement was forged and submits that the 3rd respondent has submitted a requisition to the Court of the learned Judicial Magistrate of First Class, Jangaon, requesting to collect sample hand writings of the petitioner and to send the same to the Hand Writing Expert of a Forensic Science Laboratory for furnishing an appropriate report in the matter as regards the plea of forgery and that till date, the investigation is not completed into the afore-stated crime despite necessary co-operation being extended by the petitioner for investigation into that crime.

Learned Government Pleader for Home, on written instructions, dated 10.04.2018, a copy of which is placed on

MSRM, J W.P.No.12159 of 2018 record, would submit that so far, four witnesses were examined and their detailed statements were recorded and that the further investigation into the crime is in progress and that the Police Officer already called the petitioner as well as the person accused in the crime for collection of their sample signatures for obtaining necessary report from a Forensic Hand Writing Expert and that the Police Officer would complete the investigation, as expeditiously as possible.

Recording the submissions, the Writ Petition is disposed of directing the Station House Officer, Jangaon Town and Mandal, Jangaon District/3rd respondent herein, to complete the investigation into the afore-stated crime, as expeditiously as possible, and file a final report, either way, by strict adherence to the procedure established by law. The petitioner is reserved liberty to produce any evidence in support of his case including a copy of the report of the Forensic Expert, which is obtained in the civil proceeding. There shall be no order as to costs. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
