This petition is filed, seeking for quash of the proceedings against the petitioners, who are the accused, in C.C.No.137 of 2013 on the file of Judicial Magistrate of First Class, Nirmal. The offences alleged against the petitioners are under Sections 498A IPC and Section 4 of the Dowry Prohibition Act, 1961. 2.

Heard the counsel for the petitioners and the Public Prosecutor, appearing for the 2nd respondent. None appears for the 1st respondent in spite of notice.

The counsel for the petitioners submits that only vague allegations are made against all the accused. He further submits that A7, A9, A10, A11 are only the relatives of A1. However, since the court below has taken cognizance of the case, the petitioners can seek for discharge before the court below and agitate all their contentions before the court below. 4.

With the above observations, the Criminal Petition is dismissed. Considering the request of the petitioners' counsel the presence of the accused before the court below is dispensed with and the Court below is directed not to insist upon the presence of the petitioners unless it is necessary for the proceedings of the case.

As a sequel, the miscellaneous applications, if any pending, shall stand closed.
