THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.29624 of 2015 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for respondents.

2. The petitioner was appointed as a fair price shop dealer of shop No.40 of Kamol Village, Bhainsa Mandal, Adilabad District. The authorization of the petitioner is subsisting till 31.03.2016. While so, on 06.08.2015, the Deputy Tahsildar (Enforcement), Asifabad inspected the shop of the petitioner and noticed some variations in the stock. In view of the variations in the stock, 6-A proceedings were initiated and they are pending. The second respondent suspended the authorization of the petitioner by his order dated 14.08.2015. When no show cause notice was issued to the petitioner pursuant to the order of suspension, the present writ petition is filed.

3. The second respondent should have issued a show cause notice pursuant to the order of suspension irrespective of pendency of 6-A proceedings pending before the Joint Collector, Adilabad District.

4. In the circumstances, this writ petition is disposed of directing the second respondent to issue a show cause notice to the petitioner with regard to the irregularities alleged to have been committed by him calling upon him to submit his explanation. After receipt of explanation from the petitioner, the second respondent is directed to conduct enquiry and pass final orders thereon within a period of 60 days thereafter. No order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. _______________________________
