THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.5138 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner - accused No.1 in Crime No.286 of 2023 pending on the file of Station House Officer, Mailardevpally Police Station, Ranga Reddy District, filed for the offences punishable under Sections 354-D and 506-II of Indian Penal Code (for short 'IPC'), Sections 4(i)(ii)(V), 7(1) read with Section 6(1) of T.S. Prohibition of Ragging Act, 1997 and Section 11 read with Section 12 of POCSO Act, 2012.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State. Perused the record.

The case of the prosecution is that the de facto complainant filed a complaint stating that she was studying Engineering and one senior viz., Raghunandan Babu was harassing and ragging her to love and marry him. This petitioner viz., Murthy Uday was also

harassing her. Since both the seniors were harassing her, she lost peace of mind and consumed Dolo 650 mg tablets and also cut her left hand with a sharpener blade.

Learned counsel appearing for the petitioner would submit that all the allegations are leveled against the person viz., Raghunandan Babu and since there are no specific allegations against the petitioner, who is a student, he prayed to enlarge him on bail. He further submits that the petitioner is languishing in jail since 28.04.2023.

Since the offences alleged against the petitioner are punishable below seven (7) years and keeping in view that the major part of investigation is completed, the petitioner can be granted the relief of regular bail subject to conditions. 6.

Accordingly, the Criminal Petition is allowed and the petitioner-accused No.1 is granted bail subject to the following conditions:

i) The petitioner - accused No.1 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with

two sureties for a like sum each to the satisfaction of learned XII Additional Metropolitan Magistrate, Cyberabad at Rajendranagar. ii) The petitioner - accused No.1 shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM for a period of eight (08) weeks. iii) The petitioner - accused No.1 shall not contact the de facto complainant in any manner. In the event of petitioner either trying to contact the de facto complainant or call any of the relatives of the de facto complainant, the police are at liberty to seek cancellation of bail granted to the petitioner.

iv) The petitioner - accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
