THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.13532 of 2017 ORDER:

This Writ Petition is filed challenging the action of the Police authorities in not taking any action against the petitioner's criminal complaint dated 22.09.2014 and filing a final report on the ground of it being civil in nature as illegal and unconstitutional. It appears that on the complaint of the petitioner, FIR No.422 of 2014 was registered on 22.12.2014 and investigation was taken up. It appears that pursuant to the investigation, a final report was filed on 31.05.2015 referring the case as civil in nature before the concerned Court. Filing of such final report is also admitted by the petitioner.

In the circumstances, it is for the petitioner to take appropriate proceedings under Code of Criminal Procedure before the concerned Court where the final report was filed, but not by filing the present Writ Petition.

In view of the availability of the alternative remedy, the present Writ Petition is dismissed as not maintainable. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
