HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.19011 of 2016 Order:
The petitioner's father joined the service of the respondent Company in the year 1976 as a Casual labour. He got promotions during his service and at the time of termination of his services with effect from 01.08.2003 he was working as Haulter-Operator. It appears that he was examined by the medical board on 16.07.2003 and he was found medically unfit for underground duties. Challenging the order of termination, the petitioner's father filed I.D.No.14 of 2009 and it was pending before the Central Labour Court, Hyderabad. However, the petitioner's father expired on 17.07.2015 leaving behind him the petitioner, his mother, another brother and sister. The petitioner submitted a representation on 08.10.2015 seeking appointment on compassionate grounds and terminal benefits. When there was no response from the respondent, the present Writ Petition was filed. 2.
In this case a notice was issued on admission on 16.06.2016 and thereafter it was adjourned on three occasions. In spite of the same, no counter affidavit is filed.

In the circumstances, this Court is constrained to dispose of the Writ Petition, without expressing any view on merits, by directing the respondent to consider the representation of the petitioner dated 08.10.2015 and pass appropriate orders thereon within a period of three
(3) months from the date of receipt of a copy of this order. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
