THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.14460 of 2017 ORDER:
This Writ Petition is filed challenging the action of the third respondent in not taking action against respondent Nos.4 and 5 based on the written complaint dated 15.04.2017 submitted by the petitioner.
A reading of the complaint discloses that the petitioner and his father were living in a vacant house site admeasuring Ac.0.011⁄2 cents of land and respondent Nos.4 and 5 recently came and demanded the petitioner to vacate the place and the hut situated therein. The petitioner appears to have refused for the same. It is the case of the petitioner that the Tahsildar, U.Kothapalli Mandal, had given a patta in respect of the said land. He further states that the hut was removed and he sought the help of Police to take action. A reading of the complaint discloses that it is a civil matter. Though the petitioner stated in the complaint that his hut was removed, he filed a photograph of the hut existing on the land. The Writ Petition is, accordingly, disposed of giving liberty to the petitioner to take appropriate civil proceedings against the persons trying to interfere, if he is so advised. However, with regard to the removal of the hut, the concerned Police can verify the fact whether the hut was actually removed by the persons alleged or not by conducting enquiry on the basis of the
complaint already lodged by the petitioner. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
