Heard.

The petitioner is aggrieved by the action of the 2nd respondent in not handing over the lock put to the godown premises bearing D.No.2-2-21/7E situated at Mahabubabad, Warangal District, by shifting the seized stock to some other place. He stated in the affidavit that the stock in question has been seized in connection with Cr.No.293 of 2014 and the same is pending investigation with the 2nd respondent. The petitioner states that he made a representation, dated 23-02-2015 before respondents 2 and 3 requesting to handover the lock by shifting stock from the godown to some other place, so as to enable the petitioner to use the godown. Learned Government Pleader has received instructions, which state that the petitioner has approached the 2nd respondent pending investigation and requested to handover seized stock, lock and keys of his godown. As per his request, the seized stock i.e., 19 bags of black jaggery each weighing 50 kgs., was handed to the petitioner vide acknowledgment, dated 29-03-2015. A copy of the acknowledgment is also produced along with instructions.

Since the seized stock is already handed over to the petitioner, nothing further survives for consideration.
