THE HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.3649 of 2009 ORDER :

This Writ Petition is filed seeking to issue a writ of Mandamus to declare the proceedings in Roc.No.2183/2007-A4, dated 11-11-2008 issued by the first respondent herein granting administrative sanction for construction of Panchayat Office of Balasingayapalli Grampanchayat at Balasingayapalli Village contrary to the Gramsabha resolution passed by the earlier Panchayat Body, as illegal and arbitrary and consequently set aside the same insofar as Balasingayapalli Grampanchayat is concerned.

On a perusal of the record, there are different resolutions by the same Gram Panchayat for construction of Gram Panchayat office at Kanaparthi as well as Balasingayapalli villages. It is also brought to the notice of this Court that even though pursuant to the administrative sanction accorded by the 1st Respondent the work was entrusted to the President of Habitation Level Committee, Balasingayapalli Village, Chennur Mandal on 1701-2009, so far no construction has been started in view of the pendency of the writ petition and both villages are deprived of having Panchayat office in their respective village.

Considering the said fact, the petitioners and also the contesting respondents are directed to prefer their respective representation to the District Collector, Kadapa District for construction of a panchayat building in their respective village, informing the feasibility of such construction in their respective village. On such representations being filed, the District Collector, Kadapa District is directed to consider all the submissions of members of both villages and decide the issue afresh. Accordingly, the Writ Petition is disposed of. No order as to costs.

a sequel, miscellaneous petitions pending, if any, in this Writ Petition are closed.
