Absolutely, there is no cause of action for moving this writ petition, as the facts of the case would show that in the Prajavani Petition filed by the petitioner on 02-06-2014, 2nd respondent called for a report from respondents 3 and 4. The 4th respondent sent his report in Ref.No.A/95/2014, dated 05-07-2014 and no orders have been passed so far by the 2nd respondent on the complaint of the petitioner. The present writ petition is, however, filed questioning the said report of the Tahsildar on the ground that it contains errors by proceeding as on assumption as if there was dispute raised by the 5th respondent when there is none.

I do not see any reason to entertain the writ petition, as the 2nd respondent has not yet taken any decision and merely the report given by the 4th respondent as early as on 05-07-2015 cannot be a subject matter of judicial review by this Court, when the 2nd respondent has neither accepted nor rejected the said report as on today. Hence, the writ petition is dismissed. However, the 2nd respondent would take appropriate decision in the matter and pass further orders in accordance with law. With the above observation, the writ petition is dismissed. No costs. Miscellaneous petitions, if any, pending shall stand closed. _______________________ VILAS V.
