THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 833 of 2017 ORDER:

This writ petition was filed challenging the action of respondent Nos.3 and 4 in interfering with the civil disputes and calling the petitioner to Police Station frequently in respect of Plot No.95, situated at AU Teachers Colony, Madhurawada, Visakhapatnam.

Respondent Nos.1 to 4 filed a counter-affidavit stating that respondent No.5 approached PM Palem Police Station, Madhurawada on 23.12.2016 and lodged a written complaint against one Majji Appa Rao and four others including the petitioner herein alleging impersonation, fabrication of documents and cheating in respect of the landed property. Basing on the said complaint, Crime No.540 of 2016 was registered on the same day by the Station House Officer, PM Palem Police Station, Madhurawada and the petitioner was shown as accused No.2. During the course of investigation, three eye witnesses were examined and their statements were recorded. The investigation is under progress, but the accused are not arrested so far.

In view of the above statement made by respondent Nos.1 to 4 in the counter-affidavit, it cannot be said that they are interfering with the civil disputes.

At this stage, learned counsel for the petitioner submits that the complaint filed by the petitioner was not registered. If it is so, it is for the petitioner to take appropriate proceedings in accordance with law.

The writ petition is accordingly closed.
