HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 21210 of 2015 ORDER:
Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.
The petitioner is stated to be the Fair Price Shop Dealer for Shop No. 10 of Yelkur Village, Maldakal mandal, Mahaboobnagar District. Based on a report submitted by the fourth respondent, the third respondent issued a show cause notice on 5.3.2015, to which, the petitioner submitted his explanation on 28.4.2015. After considering the same, the third respondent passed the impugned order dated 28.4.2015 suspending the authorization of the petitioner. Challenging the same, the present Writ Petition is filed.
When the Writ Petition came up for consideration on 10.7.2015, the learned Counsel for the petitioner was asked to produce a copy of the subsisting authorization of the petitioner, but, he failed to produce the same. However, in view of the pendency of the enquiry before the third respondent, this Court is not inclined to express any opinion on the merits or otherwise of the subject matter.
Having regard to the facts and circumstances of the case, the third respondent is directed to complete the enquiry and pass appropriate orders thereon within a period of sixty days from the date of receipt of a copy of this order by duly observing the principles of natural justice. The Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence.
No order as to costs.
