HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.13029 of 2017 Order:

This Writ Petition is filed challenging the action of the third respondent in registering Crime No.477 of 2016 dated 28.12.2016 against the petitioner on the complaint lodged by the Chief Executive Officer of Telangana State Wakf Board, Hyderabad, the fourth respondent. This Court carefully perused the complaint lodged by the fourth respondent and it disclosed a prima facie case for registration of the crime. In such an event, this Court is not inclined to interfere with the process of investigation. Since the learned counsel for the petitioner submitted that the petitioner is a religious man aged about 64 years and he should not be harassed unnecessarily during the process of investigation, the third respondent is directed to follow due process of law, including compliance with Section 41-A of the Code of Criminal Procedure, 1973, while investigating the crime. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
