Gunduboina Rathnamma v. The State Of Andhra Pradesh, Rep.By Its Principal Secretary,
THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.16190 OF 2017 ORDER :
Petitioner assails the impugned endorsement dated 12-04-2017 passed by the 2nd respondent-Joint Collector, SPSR Nellore, in refusing to consider the statutory revision petition filed by the petitioner on the ground that a case in CC No.4462/2015/B2/6528/2015 pertaining to the land in question is pending on the file of Hon'ble Lokayukta. 2.
Heard the learned counsel for the petitioner and the learned Asst. Government Pleader for Revenue. 3.
Admittedly, the petitioner preferred statutory revision before the 2nd respondent against the order of the 3rd respondent-RDO, Gudur, and it is statutory revision. Mere pendency of a case on the file of Hon'ble Lokayukta in respect of the land in question will not operate as stay; more so when there is no stay granted in that matter. Only on the ground of pendency of a petition on the file of Hon'ble Lokayukta, 2nd respondent cannot refuse to decide the revision. 4.
In the circumstances, the impugned endorsement dated 12-04-2017 is set aside and the 2nd respondent is directed to
dispose of the revision, said to have been filed by the petitioner, in accordance with law, after issuing notices to all concerned and affording them opportunity of being heard in the matter.
5.
The writ petition is disposed of accordingly. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, shall stand closed.
