This Court made the following order:
WRIT PETITION No.16485 of 2015 ORDER:
With the consent of learned counsel for the petitioners and the learned Government Pleader, this writ petition is disposed of at the admission stage.
2. Petitioners claim to be the landless poor. Sri Bhogeswara Swamy and Anjaneya Swamy Temples located in Chakrala Village have 115 acres of land. Petitioners were given lease of temple lands by the Assistant Commissioner, Endowments Department (3rd respondent) for the purpose of cultivation and petitioners are cultivating the said temple lands. The lease granted to the petitioners is valid till March, 2016. As per the conditions of the lease, petitioners are paying lease amount every year and there is no outstanding amount due from the petitioners. While so, 2nd and 3rd respondents have conducted tom-tom in the village stating that lands of these two temples will be leased out to the villagers and intimated to the villagers to approach office of third respondent for this purpose.
3. Learned counsel for the petitioners contends that having granted lease to the petitioners, which is valid till March, 2016, it is illegal to conduct a fresh auction holding tom-tom in the village and it amounts to arbitrary exercise of the respondents 2 and 3.
4. Learned Government Pleader, on instructions, submits that respondents are not conducting any auction to lease out the temple lands and are not interfering with the possession and enjoyment of the petitioners.
5. Recording the said statement of the learned Government Pleader, the writ petition is disposed of as no further orders are necessary. There shall be no order as to costs.
