THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.8005 of 2017 ORDER:

Heard the learned Counsel for the petitioner. The petitioner states that he is the absolute owner and possessor of land admeasuring Ac.1.00 in Survey No.18 of Cheriyal Village of Sanga Reddy Mandal in Medak District. He states that he purchased the said property from the original owners in the year 2005. Though they received the entire sale consideration, when they did not come forward for execution of registered sale deed, he filed O.S.No.54 of 2006 on the file of the learned Senior Civil Judge, Sanga Reddy, for specific performance. The said suit was decreed on 19.07.2011. Pursuant to the Execution Petition filed by the petitioner, sale deed was executed on 20.11.2015. It is the case of the petitioner that respondent Nos.

5 to 7 are having an eye on the said property and are threatening the petitioner with dire consequences if any developmental activity is taken thereon. In those circumstances, he states that he lodged a complaint on 23.02.2017 to respondent Nos.2 to 4 for providing protection. When no action was taken, the present Writ Petition is filed. This Court carefully perused the complaint lodged by the petitioner and it does not disclose any prima facie case for entertaining the complaint, as in the said complaint it was merely stated that respondent Nos.

dire consequences to kill the petitioner and his men if any developmental activities are taken up in the said land. It is open to the petitioner to file a suit for injunction as the persons are identifiable. He could also have filed a private complaint before the concerned Magistrate. After going through the complaint, this Court is not inclined to entertain the grievance of the petitioner alleging inaction on the part of the Police. The Writ Petition is, therefore, dismissed at the admission stage, giving liberty to the petitioner to pursue the available alternative remedies in accordance with law. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
