HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 28004 of 2010 ORDER:
Heard learned counsel for the petitioners and learned Government Pleader for Revenue and Panchayat.
The present Writ Petition came to be filed seeking to declare the action of the respondents in not taking any steps to stop the illegal transportation of sand from Bikkeru Vagu, Mothkur Village and Mandal, Nalgonda District, inspite of various representations made by the petitioners as illegal and arbitrary and consequently direct the respondents to take immediate steps to stop transportation of sand.
The third respondent, who is Tahsildar, filed his counter stating that suitable steps are also taken to implement the ban orders and memos are also issued to the revenue inspector and Village Revenue Officers in this regard. It is stated that number of cases have been registered and huge penalties have been imposed wherever illegal mining of sand is detected. In view of the above, the learned counsel for the petitioners submits that no further orders are required in this Writ Petition. But, it is to be noted that illegal transportation of sand is being carried out regularly and unless some drastic measures are taken, it is impossible to prevent depletion of ground water level.
Having regard to the submissions made, the Writ Petition is disposed of directing the concerned authorities to be vigilant and cautious while dealing with the persons involved in illegal transportation of sand. No costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
