THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1122 OF 2014 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in crime No.44 of 2014 on the file of the Gajuwaka Police Station, Visakhapatnam City, registered by the respondent/police suo motu under Section 107 CrPC.

Heard and perused the material available on record. Learned counsel for the petitioners submits that the respondent/police have no power to register the case against the petitioners herein under Section 107 CrPC and as such, prays this Court to quash the proceedings against the petitioners herein. This Court is of the view that the police have no power to register the case under Section 107 CrPC and hence, the proceedings in crime No.44 of 2014 on the file of the Gajuwaka Police Station, Visakhapatnam City, are hereby quashed.
