HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.27796 of 2017 ORDER:
This writ petition is filed praying to declare arbitrary action of the respondents in imposing the new housing scheme on the members of the petitioners association as violative of Article 14 to 19 and 21 of Constitution of India and direct not to interfere with its peaceful possession and enjoyment.

Petitioner filed the letter of Tahsildar, Uppal Mandal, dated 18.03.2017 addressed to the counsel representing the petitioner, in response to the legal notice (Ex.P.4) issued by the petitioner, which would disclose that in consideration of the earlier direction of this Court in W.P.No.19017 of 2005, decision was communicated to him that the claim for regularization of the alleged possession cannot be granted and that the land is identified for construction of two bed room houses for weaker sections. This communication is not under challenge nor declaration was sought against the decision as contained in the letter referred to above.

Granting liberty to the petitioner to avail the remedy as available in law, aggrieved by the communication given to the counsel on record, in response to the legal notice, by the Tahsildar, the Writ Petition is dismissed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
